The British journalist Christopher Hitchens has recently noted that the extraordinary excitement created by l’affaire Pound, an excitement sustained for now some forty years, is partly the result of having no fewer than three debates going on whenever the poet’s legal situation and his consequent hospitalization are discussed. As Hitchens says, those questions are: “First, was Pound guilty of treason? If not, or even if so, was he mad? Third, was he given privileged treatment for either condition?”1 I propose to (...) discuss all three issues in a way that fairly reflects the fact that I am neither a physician nor a lawyer. What I know of the state of medical expertise, both today and in the period of time from 1943 to 1958 , leads me, as a layman, to believe that there is an enormous latitude of understanding among medical professionals as to the precise meaning of “insanity.” At one extreme, for some distinguished physicians, the term means almost nothing. They see it as a legal term and as therefore irrelevant to them; some of them follow the line of reasoning developed by Thomas Szasz over his long writing career, namely that “mental illness” if not illness in any ordinary sense of the term.2 For other medical practitioners, it does mean something, but only when it is redefined into much smaller subcategories and enriched with much more precise terminology, and when the given patient and his full range of circumstances are considered.What I know of the legal understanding of insanity is that there has been and is now little firm agreement about “insanity” or “madness.” Equally competent juries and courts have been able to set down findings that are more or less plausible on their face but do not seem to comport at all with each other. I tentatively conclude that whatever “insanity” now is in the United States, and whatever it was when Pound was found unfit to stand trial in 1945, the standard is not the lucid simplicity of the M’Naghten test, namely, the ability of the accused to understand the difference between “right” and “wrong.” Human mind, self-awareness, and motivations are vastly more complicated than such a test would imply. 1. _The Poetry of the Possible _challenges the conventional image of modernism as a socially phobic formation, arguing that modernism’s abstractions and difficulties are ways of imagining unrealized powers of collective self-organization. Establishing a conceptual continuum between modernism and contemporary theorists such as Paulo Virno, Michael Hardt, Antonio Negri, and Alain Badiou, Joel Nickels rediscovers modernism’s attempts to document the creative _potenza_ of the multitude. By examining scenes of collective life in works by William Carlos Williams, Wyndham Lewis, Laura (...) Riding, and Wallace Stevens, Nickels resurrects modernism’s obsession with _constituent power_: the raw, indeterminate capacity for reciprocal counsel that continually constitutes and reconstitutes established political regimes. In doing so, he reminds us that our own attempts to imagine leaderless networks of collective initiative are not so much breaks with modernist forms of knowledge as restagings of some of modernism’s most radical moments of political speculation. In the middle of the last century he played a catalyzing role in the international avant garde: He was a Zelig-like polemicist in three languages (Greek, French, and English) and across three cultural (...) capitals (Athens, Paris, and New York). But he always fought on a singular front: surrealism. Born in Lausanne in 1907, he grew up in Athens and by the later 1920s began to stand out in literary circles (he was over 6' 4") for his modernist if not revolutionary views. Starting from an interest in Freud and Marx, the subconscious and the revolutionary, Calas soon arrived at their natural synthesis—surrealism. During the period of the Seven Years' War, (...) a reconstituted militia became a focus for patriotic enthusiasm, uniting national sentiment against France and effectively eradicating the remnants of Jacobite rhetoric and aspiration. The alleged emergence of a ‘post-truth’ regime links the rise of new forms of social media and the reemergence of political populism. Post-truth has theoretical roots in the interdisciplinary field of Science and Technology Studies, with sociologists of science arguing that both true and false claims should be explained by the same kinds of social causes. Most STS theorists have sought to deflect blame for post-truth, while at the same time enacting a normative turn, looking to deconstruct truth claims and (...) subject expertise to criticism. Steve Fuller has developed a positive case for post-truth in science, arguing that post-truth democratizes science. There is currently an important debate about whether philosophical intuitions are intended as evidence for the theories philosophers promote. On one side are those who argue that philosophers do rely on intuitions as evidence; on the other side are those who deny any such role for philosophical intuitions. This paper argues that both sides of this debate are partially right and partially wrong. Intuitive judgments do not, as psychological states, function as evidence in most well-known philosophical thought experiments. Philosophers nevertheless (...) strongly depend upon these intuitive judgments. Where both sides go awry is in assuming that the importance of intuitive judgments rests solely upon their role as evidence. We need to distinguish between evidence, as such, from various nonevidential psychological states that are needed for something else to serve as evidence. The paper calls these latter conditions “evidence facilitators” and argues that intuitive judgments belong in this category. (shrink)

Extracorporeal membrane oxygenation (ECMO) is a form of life support for cardiac and/or pulmonary failure with unique ethical challenges compared to other forms of life support. Ethical challenges with ECMO exist when conventional standards of care apply, and are exacerbated during periods of absolute ECMO scarcity when “crisis standards of care” are instituted. When conventional standards of care apply, we propose that it is ethically permissible to withhold placing patients on ECMO for reasons of technical futility or when patients have (...) terminal, short-term prognoses that are untreatable by ECMO. Under crisis standards of care, it is ethically permissible to broaden exclusionary criteria to also withhold ECMO from patients who have a low likelihood of recovery, to maximize the overall number of lives saved. Unilateral withdrawal of ECMO against a patient’s preferences is unethical under conventional standards of care, but is ethical under crisis standards of care to increase access to ECMO to others in society. ECMO should only be rationed when true scarcity exists, and allocation protocols should be transparent to the public. When rationing must occur under crisis standards of care, it is imperative that oversight bodies assess for inequities in the allocation of ECMO and make frequent changes to improve any inequities. The author uses a series of potential counterexamples to argue against attempts by Bergmann and Plantinga to articulate a distinction between malignant and benign epistemic circularity and, more radically, to argue that epistemic circularity per se is no fallacy, and the concept of epistemic circularity plays no role in the explanation of why some instances of epistemic circularity are irrational. The author contrasts an inferential framework, in which circularity is a problem, with an equilibrium framework, in which the concept of (...) circularity plays no useful role and argues that defeasible reasoning can only be understood in an equilibrium, not an inferential, framework. The author uses an example of reasoning about the reliability of one’s own memory to explain how seemingly malignant epistemic circularity can be rational in an equilibrium framework. The author discusses the relevance of this conclusion to two contemporary issues: the cogency of Plantinga’s Evolutionary Argument against Naturalism and the evolutionary naturalists’ challenges to non-naturalist moral realism—and, indeed, to all forms of non-naturalist normative realism. He includes under this heading, "Celibacy, fasting, penance, mortification, (...) self-denial, humility, silence, solitude." No doubt Hume's stance regarding the "monkish virtues" does fit into a particular vision of the desirable life, but it may be questioned whether it fits his philosophy with full consistency. In this paper, I will argue that Hume's explicit formula for identifying virtues fails to justify his rejection of the monkish virtues if it is followed without prejudice. I. Identifying Virtues Our whole comprehension of virtue, and our competence to identify it in any community, ultimately derives from our perception of virtue in particular instances. The edifice of morality reaches into the thin air of abstractions and general rules, but it does not begin there and it is always grounded in the concrete experience of human individuals. In the most basic case, what we perceive is not (say) the trait of kindness as embodied in George.2 We rather perceive the whole phenomenon of George in his particular situation. We know that as any individual's time on earth mounts up, and as one gains a few years of experience, he or she will gradually acquire abstract ideas and the words which signify them. Here in brief is Hume's account of the formation process (T 17-25). The first order of business is to notice a resemblance among certain objects of experience; we apply the same word to all of them. Thus, we would gather indefinitely many instances in which the word 'kind' is applied to something, or where somebody speaks of 'kindness.' The word becomes associated with a certain custom, or habit of mind, which custom is evoked whenever we hear or speak that word, or at least whenever the word is used wrongly. In that event, the custom fires up some relevant counterexamples for our attention. If somebody asserts, "True kindness is always well-planned and fully reflective," our mind instantly lights upon cases of spontaneous or impulsive kindness. If we should overhear, "She is a very kind person, so people don't like her," we know that something is amiss. Our competence in handling abstract ideas clearly underwrites the catalog that Hume confidently envisions at the start of his second Enquiry. We can make two lists, one for virtues and one for vices. In this process, Hume thinks, "The very nature of language guides us almost infallibly" (EPM 174). We can easily appreciate why it should be so. Our moral epithets are mounted on items of direct perception. Our understanding of a particular word is really a custom of associating certain elements of our own experience. A philosopher can "enter into his own breast" for a moment, and consider whether or not he should desire to have this or that quality ascribed to him. 2. His one major surviving work, often titled 'meditations' but literally translated simply as 'to himself', is a series of short, sometimes enigmatic reflections divided seemingly arbitrarily into twelve books and apparently written only to be read by him. For these reasons Marcus is a particularly difficult thinker to understand. Howard Van Till 's review of my book No Free Lunch exemplifies perfectly why theistic evolution remains intelligent design's most implacable foe. Not only does theistic evolution sign off on the naturalism that pervades so much of contemporary science, but it justifies that naturalism theologically -- as though it were unworthy of God to create by any means other than an evolutionary process that carefully conceals God's tracks.

Research on this topic in Europe and North America has reached a new stage. Prior to 1970, historians told a story of progress in which modern individuals gradually gained mastery of emotions. After 1970 this older approach was put into doubt. Since 1990 research into the history of emotions has increasingly relied on a new methodology, based on the assumption that emotion is a domain of effort, and that it is possible to document variance between emotional standards, on the one (...) hand, and the greater or lesser success of individuals in conforming to them, on the other. During the course of this short article, I respond and connect with insights and issues raised by the Conversational Rollercoaster and its relationship with conversation analysis and the public science of talk. I constructively engage with the innovative thinking and practice associated with this initiative. Finally, I consider how this might enhance a potential drive to connect ethnomethodology and CA to additional public and collaborative practices and interventions in the digital age.
